Cromagnon: The order of house arrest of one of the convicted was rejected

The Federal Court of Criminal Appeal decided, by majority, reject the house arrest requested by the lawyer of convicted Ana Maria Fernandez.
It was decided in the case known as Cromagnon and is about the presentation by the lawyer of Ana María Fernández to get house arrest, as the mother of a child currently in period breastfeeding.
The majority understood that right now the child’s health as well as her mother is not at risk and that the detention unit where Fernandez is hosted has sections to accommodate mothers with children and the necessary elements for provide the care required by minors.
The minority vote considered, based on the best interests of the child, which is sufficient to grant the arrest of the mother.
