Judgment against the Income Tax: The deemed unenforceable

In Mar del Plata, a federal judge ruled in favor of a plaintiff who claimed not to charge the income tax by having claimed the bonus.
The head of the Federal Court No. 4 of Mar del Plata, Alfredo Lopez, ordered that no charge the tax to the plaintiff, because there was no update tax allowance.
“It should be noted that in the last decade, characterized by great social and economic crisis that our country faced at the beginning of 2002, the tax allowance was undergoing several updates by the national state,” he said in his ruling.
“So far in 2012, and despite missing a few months longer to finish the year, the non-taxable minimum income tax has not been changed. Whereupon, the question is whether, given the economic / social situation currently in Argentina and the particular situation of amparo, it is reasonable that such amounts continue unchanged. “
