Media Law: The Supreme Court unlocked divestment article on concentrates groups

The Supreme Court unlocked a key article of the Media Law that has kept the national government and the Clarín group in a dispute unprecedented.

Article 161 is forcing media concentrated groups to divest when controlling tops are overcome, in order to avoid monopoly.

In this scenario, the Court ruled unanimously unlock this article that had been suspended for Clarin through an injunction, which expires on December 7.

For the high court interim measures “are poor judicial decisions and can not replace the fundamental solution because they affect legal certainty.”
