Ciccone case: Lawyer of Carmona asked to recuse the prosecutor Rivolo
Argentina, April 11, 2012
Today, Carmona’s lawyer in the case Ciccone, Diego Pirota, spoke to CN23 about the decision formally presented to the judge Rafecas recently. Pirota asked the federal judge to recuse the prosecutor Carlos Rívolo, considering that he has “lost objectivity in the case.”
Thus, he argued “after seeing the evidence, as well as the procedure, we propose the disqualification of the prosecutor because we understand that there was a manipulation of the case and the evidence” and added “the manipulation led to the raid.”
“We find in the record that the prosecutor has manipulated the tests, in addition to the publishing information about the raid. Also realized that there is information given to the prosecution of people who have an interest to finish the case” he said.
Asked about the objectivity of the prosecutor, he added “we are asking his apartment not for political reasons or media, but after seeing the cause, we conclude that the prosecutor (Rívolo) has lost objectivity in the cause as well of violating the gag order.”
He concluded, “the federal judge has to decide if the disqualification is confirmed or not. He handles the times. The prosecutor has no obligation to be impartial, but he is not objective.”
