Zaffaroni: “The conflict for the subways is going to be prosecuted”
Argentina, March 12, 2012
Eugenio Zaffaroni, minister of the Supreme Court of Justice (SCJ), said the high court may exercise jurisdiction in the conflict between a federated entity and the federal government, due to the conflict between the Government of Buenos Aires and the national Government for the transfer of the subway.
“I can not give an opinion because it certainly is something that is going to be prosecuted” adding “the conflict between a federated entity and the federal government is a matter that makes the jurisdiction of the Court.”
The minister said that “in principle, the Court is empowered to resolve conflicts that arise between a province or the City of Buenos Aires and the Federal Government.”
On the other hand, he said “unfortunately the problems that are not resolved in the political arena are settled in court and this has not always a satisfactory solution.”
Also, Zaffaroni said that “the original jurisdiction of the Court is able to deal with the problem, as stated in the Constitution since 1853,” meaning that the trial starts from the Supreme Court.
