A transsexual, condemned for raping a woman, joins jail with women

A transsexual condemned for violating a woman in 1998 has obtained the transfer to the women penitentiary center of Alhaurín of the Tower, Malaga. The Provincial Hearing of Malaga has authorized the change, despite the opposition of the District attorney’s office, on having verified that the recluse appears as woman in the civil record.

The Public Department has denounced a few facts considers to be “incoherent” because the transsexual preserves the masculine genitals and the victims of his crimes (a violation, sexual harassment and familiar abuse) have always been women.

Also, the district attorney’s office contributes with “multiple medical reports” that reveal the repeated denial to submit him to an intervention of sex change after to be diagnosed with personality disorder in which “the alteration of the sexual identity is one more symptom and not a real transsexualism”.

The Hearing argues that his genitals are “atrophic”, therefore he cannot be considering “an issue of danger”.

The recluse, native of Línea de Concepcion, managed in 2008 to register himself with woman’s name and feminine sex in the Civil Record of San Fernando (Cadiz) and initiated the steps to obtain his transfer to the women’s jail.
